In this malpractice action, a jury awarded $805,000 in actual and punitive damages. The last offer from the insurance company before trial was $60,000.
$875,000.00 Settlement - Wrongful Death
The wrongful death of a surgical patient due to the surgeon and hospital administration deciding to continue with surgery despite the fact the patient was having unrelieved chest pains and was on blood thinners. The patient died from a heart attack on the operating table. The hospital settled after the first witness. The last offer before trial was $500,000. The hospital was protected by the Tort Claims Act cap of $1.2 Million.
$800,000+ Verdict - Truck Accident
Over against a log truck owner who caused the death of another trucker when the wheels of the log truck came off and struck the victim’s truck causing him to lose control and strike a third truck. Other defendants settled for over $225,000 in addition to the workers compensation benefits paid to the widow.
